Booking Terms & Conditions

 

Accommodation

Your contract is with ALBATROS VILLA (“we”, “us” and “our” in these Booking Conditions) for the property known as ALBATROSVILLA.COM (“the Property”).  References to “you” or “your” are references to the person making the booking and all members of the holiday party. 

These Booking Conditions form the basis of your contract with us so please read them carefully.  Nothing in these Booking Conditions affects your normal statutory rights.

 

1.      Making your booking

When you book the Property with us you should return the completed Booking Form to us together with your payment for the Initial Deposit.  Please note that the Initial Deposit is only refundable if you cancel your booking within seven days of receiving our written confirmation of your booking.

Your booking is made as a consumer for the purpose of a holiday and you acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you.

Once the completed Booking Form and the Initial Deposit have been received and accepted by us, we will issue you with our written confirmation.  The contract between us will only be formed when we send you our written confirmation and is subject to these terms and conditions.  We reserve the right to refuse any booking prior to the issue of our written confirmation.  If we do this we will promptly refund any money you have paid to us.

You should carefully check the details of our written confirmation and inform us immediately of any errors or omissions.

The rental of the property is self catering and all rates quoted are FULLY INCLUSIVE PRICES and this does not include the standard £145 final cleaning fee.

2.         Paying for your booking 

You are required to send to us your payment of the deposit and the balances subject to the rental contract.  If you fail to make a payment due to us in full and on time we may treat your booking as cancelled by you.

3.         Services 

(a) Cots & High Chairs
FREE use of 2 sleeping Cots and 3 Highchairs. Additional requirements are available upon request and rental rates may be applicable.

(b) Baby Sitting Service
Available upon request.

(c)Shopping Service
We offer a service whereby we stock up the cupboards for your guests.  All you would pay is the cost of the shopping bill plus a 10% service charge.

(d) Free Swimming Pool Heating

FREE Solar Pool Heating is provided for your stay and well being. This is dependant upon the weather and other factors, and assumes that the pool will be covered with the solar pool cover which is provided, when the swimming pool is not in use. Pool heating should be adequate during the swimming season between April - October.

(e) Air Conditioning, Air Condition, Air Con, AirCon, A.C, AC

The Villa is Air Conditioned and has a card meter for reasonable and fair use.  You will be provided with a FREE CREDIT of £5 per day which should be more than adequate for your requirements and assumes that the windows and doors will be closed during use, or periods of absence. 

(f) Free Broadband Internet & WiFi

The Villa has 2 x Wi Fi access points for high speed broadband Internet for you to catch up with friends, family and business associates.

4.         Villa Policies

(a)  No Pets Allowed

(b)  Smoking Policy

Due to health & safety, and well being of all of our guests, smoking is strictly not permitted indoors.  If you wish to smoke then there are designated smoking areas outdoors.
 
(c) Rental rates

The rental rates are based on the occupancy figure stated in the contract for your group + baby in cot.  We reserve the right to refuse admission or charge an additional pro rata rate for any additional guests staying at the property.

5.         If you cancel or amend your booking

If you need to cancel or amend your booking you must telephone us on the number shown on our written confirmation as soon as possible.

You will also be required to confirm your cancellation in writing or by email to the addresses shown on our written confirmation.  A cancellation will not take effect until we receive written confirmation from you.

If you cancel your booking within seven days of receiving our written confirmation, we will refund the balance of any money you have paid us.  After this period, if you cancel your booking, we reserve the right to retain all monies paid to us and or apply a credit against any future reservations at our property.

If you cancel your booking less than 30 days prior to the Arrival Date, we reserve the right to retain the full rental amount paid, unless we are able to secure an alternative booking for the Property.

If you terminate your stay before the departure date for any reason, you are still obliged to pay the full rental price.

6.         If we cancel or amend your booking

We would not expect to have to make any changes to your booking, but sometimes problems or emergencies may occur and we may have to make alterations or, very occasionally cancel bookings. 

If this does happen, we will contact you as soon as is reasonably practical and inform you of any cancellation or change to your booking.   If it is necessary to cancel your booking, we will refund the full balance of any money you have paid to us, or offer you alternative holiday accommodation on a like for like basis at no additional costs.

7.         Your Accommodation - Arrival & Departure Times

You can arrive at the property after 16.00 hours (4pm) on the Arrival Date and you must leave by 10.00 hours (10am)  on the Departure Date.

If your arrival will be delayed, you must contact : Dorothy or Danny on: Tel: +44 20 81 23 81 19 so that alternative arrangements can be made.  If you fail to do so, you may not be able to gain access to the Property.  If you fail to arrive by midday on the following day (after the Arrival Date), and you do not advise us of your anticipated late arrival we may treat your booking as having been cancelled by you.

8.         Welcome Pack

A FREE welcome pack is provided for you on your arrival.  This includes a selection of fresh fruits, local produce and lovely bottle of Cava wine.

9.         Pool Cleaning

Our sparkling clean swimming pool is maintained, cleaned and checked for proper chlorine and PH levels, for your total safety and well being.  This pool cleaning is carried out by us, two times per week, very early in the morning so as to minimise any disruption to your holiday vacation.

10.      Garden Maintenance

If you are staying at the property  for 2 weeks or longer, then the garden will be maintained to allow for lawn cutting.  This will be carried out after the 1st week with some flexibility to offer you total privacy and discretion.

11.       Clean Towels

You will be provided with clean towels and bedding for each guest.  If you are staying at the property  for 2 weeks or more, then you will be provided with an extra set of clean & fresh towels after your 1st week vacation.

12.      Midweek Clean – If staying for 2 or more weeks

A general mid-week clean is available if required and includes a changeover of bed linen.  Our charge is £50 for this service and we will require 48 hrs reasonable notice.  Payment for this service is deductible from the refundable security deposit.

13.      Refundable Security Deposit

We will require a standard Refundable Security Deposit of £300 to be applied against the reasonable cleaning, damage, and/or replacement of the property, furnishings, fixtures and fittings.  We will return your Security Deposit less any deductions in accordance with the conditions contained in the contract, to you within 2 days of the return of the keys and remote control to us.

14.      Final Cleaning Fee

Our standard £145 final cleaning fee will be applied against all bookings & reservations at our property for the reasonable cleaning of the property after your departure.  This will become deductible from the Refundable Security Deposit after you vacate the property. 

You are required to return the property in a reasonable condition.  Any additional cleaning costs over and above what is considered reasonable, which is due as a direct result of negligence or breach of contract will become chargeable at the additional rate of £100

15.      Gas Barbecue BBQ

A top of the range gas BBQ will be provided for your al fresco dinning experience.  This will be provided to you in a very clean condition and must be returned back to us in a similar & reasonable condition.  As it takes approximately 3 hours to fully clean and prepare the gas BBQ, a very reasonable charge of £30 will be levied against the security deposit, if the gas barbecue is not returned cleaned and in a reasonable condition.

16.      Property Managers

The managers of the property are available on-site in a separate, self-contained office / apartment and are available to assist you with any of your adventures and travel plans.  Whether you want to charter a boat, go on a balloon ride, or simply arrange for a round of golf at our local golf course, everything is possible and can easily be arranged for you.

We are also available to assist with any health, medical or emergency doctor issues.  You will also have FREE access to our private doctor for any unexpected emergencies and free translation and mediation service.  Whilst are very responsive to all of your requirements, we also offer you total privacy to the entire villa and grounds and private use of the swimming pool at the property.

The gated entrance, and part of the driveway is shared with the management. 

We have English, Spanish and Russian-speaking representative are on hand to answer any questions.

17.      Your obligations

You agree to comply with the reasonable Regulations of our property and any other regulations reasonably made from time to time, and ensure that they are observed by all members of your party. 

You are held responsible for the actions of other people, including any guests or visitors they might have, within the property.  You accept liability for any damaged goods, damage to the property or damage to anything else related to the property or owners belongings, whether caused by you or your accompanying guests or visitors.  You agree to keep and leave the Property and all fixtures and furnishings, both inside and outside, in a clean and reasonable condition.

You also agree not to cause any damage to the walls, doors or windows of the Property nor to rearrange the makeup of the property without our written consent or to do anything that may be reasonably considered to cause a nuisance or annoyance to any other neighbouring properties.

You agree to take all necessary steps to safeguard your personal property.  No liability to you is accepted in respect of damage to or loss of such property, except where the damage or loss is caused by our negligence.  Faults that are found before or during the rental period are to be reported to the owner immediately and within the first 24 hours.

You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).  You also agree to bring with you, any European (EHIC Card) or equivalent Emergency Health Card for the duration of your holiday.

You agree not to allow more people to stay in the Property than expressly authorised & agreed in your booking, nor can you significantly change the makeup of the party during your stay in the Property, nor can you take your pet into the Property unless it has been arranged in advance and it is shown on your confirmation.  If you do so, we can refuse to hand over the Property to you, or can require you to leave our property. We will treat any of these circumstances as a cancellation of the booking by you.

You agree to allow us or any representative of ours access at any reasonable time during your stay for the purpose of essential repairs, maintenance or emergencies and will be advised of these works beforehand to ensure that there will be no disruption to you or your guests.

18.   Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday.  If however, you have any cause for complaint it is important that remedial action is taken as soon as possible and you advise us immediately during your stay.

It is essential that you contact us if any problem arises so that it can be promptly resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we are swiftly notified. Discussion of any criticisms with us whilst you are in residence will usually enable shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence.

If any complaint cannot be resolved during your holiday, you must write to us with full details within 7 days of your departure date.

19.    Our liability

Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited, and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. 

This does not include or limit in any way our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

20.    Puiblic Liability

Unlike a large number of Holiday Letting Companies and Villas, we have extensive public liability insurance in place to protect you, your guests and family.  In the very unlikely event of an injury, any claim must be notified to us in writing immediately. 

 21.    Law

The contract between you and us is governed by the law of Spain and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Spanish Courts.  These terms and conditions and any matters contained in them are subject to change without prior notification, full details of which can be found on our www.albatrosvilla.com website.
